6 Month Labor Ban Under Review

Labour ministry reviews six-month work ban rule

Dubai: The Ministry of Labour is reviewing the six-month work ban, enforced when a person cancels work permit, to facilitate labour movements within the country, an official said.

Abdul Razzaq Qambar, training officer at the ministry’s inspection department, said during a seminar on wages, aimed at raising awareness on workers’ rights, that a review of the six-month ban was on the table.

“The ministry is studying different means to facilitate labour movement within the country and the reviewing of the ban is part of this,” said Qambar.

However, no time frame was given.

Jasem Al Banna, head of the legal affairs department at the ministry, said during the seminar that people had the right to progress in their career and they should not be prevented from doing so.

Currently, the ministry enforces a six-month ban on working in the country if the worker who cancels his permit does not have a no-objection certificate from his employer.

The ban does not apply if the person has been working in the company for more than three years. The seminar outlined the six major violations committed by companies hit by the global economic downturn.

During the past four months, the ministry has seen an increase in cases where employees have not been paid in more than a month, cases where salaries have been reduced without workers’ consent…

    This will certainly help a lot of employee who have been made redundant from jobs for no reason due to economical crisis recently and as said by Mr. Jasem Al Banna said every individual has the right to progress and should not be stopped fro doing so. It will be good for the economy of the country too because as more people leave, the consumption of products in the market also gets lesser as everything is linked to each other, this law of “NO 6 MONTHS BAN” should be passed at the earliest possible as there are several people suffering the below situation given and some are even undergoing more critical situations.

    I am a travel agent, I was on a limited contract, i have been working with this company for 14 months and now due to the current financial crisis, my company has given me End of service letter without NOC, i have achieved targets more than what was given to me and i have been a good performer for which I have got proof in written too, but when asked why this letter to me, the reason given was, company cannot afford much staff and the letter says “due to rescheduling of office your duty has been redundant, thanks for your service and cooperation with us and so on” but when it comes to NOC, they say its company policy and they cannot give it to anybody no matter whatever the reson is, this is something troubling and irritating, I stay here with my family and have got several commitments, but as per the law I have will get a auto ban for 6 months if I don’t have NOC and I cannot work in entire U.A.E even though if a company is ready to appoint me, except free zones where options of my industry is very less, this is the reward I got for my sincerity, I got my carrer spoiled and i will have to stay apart from my family for 6 six months and return back to my home town, Is this the unexpected future of any person of any nationality residing in U.A.E . I believe laws are made for the benefits of people and with equal rights. Can law or government sort out this query? Awaiting for your earliest reply as i have got only less than a month left to leave Dubai now.

    I feel for you. A good friend of mine who worked in HR for a car company here in the UAE was made redundant after she had to choose who to layoff. The gave he option of layoff, or resignation. She has an NOC, but because she left the company she only has 30 more days as her visa was canceled on Sunday. If she had accepted layoff she would have had 90 days. There are so many ways that companies are gaming the issue right now.

    Also, many companies are playing fast and lose with salary and contractual issues as well… Everyone, be careful out there!

    2 days still no news of law passing, people continue going, is this articles which everybody sends noticed by the authorities of government, a friend of mine is leaving back to his home town who is far more experienced than me diapppointed saying i dont know when this rule will apply and i cant bear the expenses anymore without job and as he too did not got noc and was made redundant for no other reason but only financial crisis, employers are also taking benefit of this and many politics and rivalries are going on within comapnies in the name of crisis, i dont understand what do get by spoiling a career of somebody, its high time the goverment looks into these issues seriously and quickly as people around the globe working in uae are moving back either disappointed or forcibly as they have no options left. This again also effects the nation as people keep on moving back to their countries and the news spreading more and more investors for other nations would also think twice of investing in here which as the result effects the economy again

    You are seriously right. Companies are playing all kinds of games and there are not enough government workers to even begin to look into the violations. Accordingly, many people are just giving up and returning home.

    Things are getting worse here in the UAE, not better. The story I posted about Dubai Ports is just another part of the story that's unfolding. It's a perfect economic storm.

    Dear Sir, My name is Subeesh and i am working in a company in Dubai, I had complited my 31 months in my employment Visa and now only 5 months more. I am having problem with my salary last few months i am getting my salary late, normaly we 'll get it on 5th of every month and now 20th or 22th some months 15th. So i tried for another job and i got one also.i told my employer that i got a job in another company,i requested him for NOC.but the employer is not ready to give me NOC. Is it possible with out NOC i can change my job?? please advise me what to do???

    Dear Sir,
    I want to know just when “No Ban Policy” law will implement. I’m working in a group of company my sponsor told me that he will pay me 2500 dhms he violate the contract and paying me only 1700 dhms i have spend more then one year i asked management two three times regarding my salary i explain my situation that I am elder in my family and i have seven(7) dependants salary is two less for me difficult to survive but they are not giving positive response in my company there is no increment policy no bonus no facilities even they are not giving vacations after one year as per government rule that’s why i want to switch my job but if i will resign they will place ban on me i want to change my job with better salary package but due to ban policy i can't switch, so please review this policy and give some relief to employers fast.
